This Terms of Service Agreement (the “Agreement”) is made and entered into by and between The Mac Parkman Foundation for Adolescent Concussive Trauma Inc (the “Company”) and the user (the “User”) of the Company’s services. By using our services, the User agrees to be bound by the terms and conditions of this Agreement.

  1. User Information

The Company acknowledges and understands the importance of protecting the User’s personal information. The Company hereby confirms that it will not give away or sell the User’s information to any third party without the User’s prior consent, unless required by law.

  1. Services

The Company provides various services to support its mission as a non-profit organization. The nature and scope of these services may vary and will be determined by the Company at its sole discretion. The User understands and agrees that any changes to the services provided by the Company may occur without prior notice.

  1. User Responsibilities

The User acknowledges and agrees to use the Company’s services in a lawful manner and for the intended purposes only. The User shall not engage in any activities that may cause harm, disruption, or interfere with the Company’s operations or violate any applicable laws and regulations.

  1. Intellectual Property

All intellectual property rights, including but not limited to copyrights, trademarks, or any other proprietary rights related to the Company’s services, shall remain the exclusive property of the Company. The User shall not reproduce, modify, or distribute any content from the Company’s services without obtaining prior written consent from the Company.

 

  1. Limitation of Liability

The Company shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from the use of its services. The User agrees to use the Company’s services at their own risk and acknowledges that the Company shall not be held responsible for any loss, damage, or liability incurred as a result.

 

  1. Termination

This Agreement may be terminated by either party at any time for any reason with written notice to the other party. The Company reserves the right to suspend or terminate the User’s access to its services without prior notice if the User violates any terms of this Agreement.

 

  1. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Florida, without regard to its conflict of laws principles. Any legal actions or proceedings arising out of or relating to this Agreement shall be exclusively brought in the federal or state courts located within the state of Florida.

 

  1. Entire Agreement

This Agreement constitutes the entire agreement between the Company and the User and supersedes all prior agreements, representations, and understandings, whether written or oral, relating to the subject matter of this Agreement.

By using the Company’s services, the User acknowledges that they have read, understood, and agreed to be bound by the terms and conditions stated in this Agreement.
